1. ETHICS: Attorney-Client Privilege in Internal Investigations
Internal investigations by inside or outside counsel are an essential tool for companies, but the scope of the attorney-client privilege in such invitations is never clear. In this presentation, attorneys with years of experience conducting internal investigations will discuss how to identify what law applies, the contours of the privilege in various settings, and other ethical concerns involved in internal investigations, including protection of the privilege, waiver, and internal communications of investigation results to ensure that in-house counsel successfully navigates the potential pitfalls of bringing in outside counsel to assist in internal investigations.

2. False Claims Act Litigation: Factors Influencing Government Intervention
This program will break down the elements that comprise an FCA claim and will teach participants how to accurately evaluate claims of falsity,intent, and materiality. An experienced, former DOJ counsel will provide an insider perspective on the factors that may make a case attractive to the government, as well as factors that may lead the government to decline intervention. The program will include a discussion of recent examples where the government intervened and declined to intervene in cases.
